29 CFR 1926.601(b)(4): The employer had in use motor vehicle equipment having an obstructed view to the rear which did not have a reverse signal alarm audible above the surrounding noise level or an observer signaling it was safe to back up the vehicle: (a) Jobsite, PA Turnpike Mile Post 124.55 East Bound, Somerset, PA: On or about September 24, 2019 an employee was fatally struck by a single axle dump trump operating in reverse. The dump truck was being used to collect asphalt millings and did not have a functioning reverse signal alarm nor was a spotter being used.

29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage which could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices: (a) Jobsite, PA Turnpike Mile Post 124.55 East Bound, Somerset, PA: On or about September 24, 2019 single axle dump truck 98 used on the worksite was not checked at the beginning of the shift to ensure that all safety devices were in operating condition. The truck was involved in a backup/reverse incident that resulted in a fatality. The reverse signal alarm was tested immediately following the incident and found to be inoperable.
