For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. (a) On or about August 19, 2019 and at times prior to, the controlling employer did not ensure that their subcontractor, utilizing a Troxell 06-2000 5 inch grinder to shape sandstone, implemented wet methods, a vacuum system and/or respiratory protection to control respirable silica dust being created on the jobsite. Note: Abatement certification AND documentation ARE required for this item.
