29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: a. On or about October 1, 2019, in the workplace, employees were provided half-face and full-face tight fitting respirators with organic cartridges for voluntary use. The employer did not establish and implement a written respirator program that includes at a minimum, the following elements: (i) Medical evaluations to ensure employees are medically able to use a respirator. (ii) Procedures for cleaning, storing, and maintaining the respirator to prevent a health hazard to the user.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer: a) On or about October 1, 2019, employees molding costume heads, claws, teeth, and eyes with chemicals including, but not limited to, Flexform-iT III and Plasti-Paste II were provided half-face and full-face tight-fitting respirators for voluntary use. The employer did not provide the information contained in 29 CFR 1910.134, Appendix D ("Information for Employees Using Respirators When Not Required Under the Standard").
