29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d):  29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.   Vista Ridge Apartment Homes Building 4:  On or about October 01, 2019, and at times prior thereto, employees were operating a Genie Telehander 1056 (SN: 38870) to elevate a job made wooden platform without training and certification.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards.  On or about October 25, 2019, and at times prior thereto, employees were exposed to a fall hazard while working on a 2-story apartment home roof without training in recognizing fall hazards and how to minimize exposures to such hazards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     Vista Ridge Apartment Homes Building 4 : On or about October 01, 2019, and at times prior thereto, employees were exposed to a fall hazard greater than 6 feet while performing roofing work on an apartment home without fall protection.  Raul Romo Rodriguez dba ANR Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA  inspection number 1434842, citation number 1, item number 1 and was affirmed as a final order on May 06, 2019, with respect to a workplace located at 1810 E Colorado St, Victoria, TX. 77901.
