29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph. (a) Apartment Building #9, West side of structure: On or about 10/01/2019, and at times prior, the employer exposed employees to collapse/fall hazards of over 19-feet to the lower level, in that the tubular welded scaffold used to install stone on the chimney was erected 6-sections high and was not secured to the structure.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. (a) Apartment Building #9, West side of structure: On or about 10/01/2019, and at times prior, the employer exposed employees to fall hazards of 19-feet and greater while accessing the scaffold platforms, in that a safe means of access was not provided to access the working levels of the scaffold. Employees climbed scaffold frames, guardrails, and cross-bracing to access upper and lower working levels of the scaffold system.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. (a) New Apartment Construction, Apartment Building #9, West side: On or about 10/01/2019, and at times prior, the employer exposed employees to silica exposure while cutting decorative stone, in that the DeWalt 4-1/2-inch angle grinder with masonry blade used to cut stone was not equipped with a integrated water delivery system or a shroud with dust collection system while dry cutting.
