29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. Eagle Industrial Painting LLC., on or about October 02, 2019, at the address of 102 West Erie Street, Lorain, OH: Two employees were exposed to a fall of approximately 23 feet. The employees were performing cleaning and painting operations on the outside of the underside of the bridge structure. The employees were working from an aerial lift without the benefit of fall protection.

29 CFR 1926.454(b): The employer did not have each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question. The training did not include the following topics, as applicable: The nature of scaffold hazards; Eagle Industrial Painting LLC., on or about October 02, 2019, at the address of 102 West Erie Street, Lorain, OH: The employer failed to ensure employees utilizing an aerial lift system were adequately trained by a competent person to recognize and avoid hazards specifically associated with this type of aerial lift operation, such as fall protection requirements while working from an aerial lift over water.
