29 CFR 1926.451(c)(2)(v): Forklifts were used to support scaffold platforms without ensuring the entire platform was attached to the fork. On or about 1 October 2019, and at times prior thereto, an employee stepped into a wooden box at the second level of a garage for unloading tools and equipment. The box was not attached to the forks and had no fork pockets to prevent tipping. The workers unloading the box were exposed to the hazard of falling approximately 14-feet 9-inches to hard packed soil below.

29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems or personal fall arrest systems. If an employee must lean through the access opening or out over the edge of the access opening to receive equipment and materials that employee shall be protected from fall hazards by a personal fall arrest system: On or about 1 October 2019, and at times prior thereto, an employee went over the parapet wall without fall protection and stepped into a wooden box at the second level of a garage for unloading tools and equipment. The employee was exposed to the hazard of falling approximately 14 feet 9 inches to hard packed soil below.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. On or about 1 October 2019, and at times prior thereto, a forklift was used to move tools and equipment in a wooden box to the second level of a garage for unloading. The wooden box was not attached to the forklift, did not have fork pockets, did not have the tare weight identified, and was not placed up against the backstop of the carriage. The forks were not adjusted for maximum width, exposing the workers to an unstable load and struck-by hazards where operation did not account for dynamic forces.
