29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  The employer is failing to protect employees from the physical hazard of being struck in the eye by flying particles of metal, wood or asphalt shingles.  This violation was most recently documented at a worksite located at or near 7230 171st St., Bennington, Nebraska 68007 on October 3, 2019.  Employee(s) were nailing decking without using personal protective eyewear.

29 CFR 1926.451(g)(1):  Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    The employer is failing to protect employees from fall hazards. This was most recently documented at 7230 171st St., Bennington, Nebraska 68007 on October 3, 2019. The employer failed to ensure that fall protection was used by employees working on a supported scaffold that was approximately 21 feet above the ground which was attached to an Ahern Xtreme forklift.

29 CFR 1926.454(a):  The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards as required by paragraph (a)(1) of this section:                                                                                                    The employer is failing to protect employees from fall hazards. This was most recently documented at 7230 171st St., Bennington, Nebraska 68007 on or about October 3, 2019.   The employer failed to ensure that fall protection was used by employees working on a supported scaffold that was approximately 21 feet above the ground which was attached to a Ahern Xtreme Mobile Forklift were trained to the nature of fall hazards as a result of the condition of the scaffold that had a lack of fall protection.
