29 CFR 1926.502(b)(4): The top edge of the guardrail was able to deflect to a height less than 39 inches (1.0 m) above the walking/working level: Instances including, but not limited to, the following: a) Job site, 320 East North Avenue, Pittsburgh, PA: On or about October 1, 2019, during construction activities near a stairway floor opening on floor level 1, the employer did not ensure that guardrail systems were compliant in that the top rail was able to be pushed down by hand to a level of at least approximately 37 inches. b) Job site, 320 East North Avenue, Pittsburgh, PA: On or about October 1, 2019, during construction activities near the front of the building on floor level 2, the employer did not ensure that guardrail systems were compliant in that the top rail was able to be pushed down by hand to a level of at least approximately 35 inches.
