29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high: a) Job site, 320 East North Avenue, Pittsburgh, PA: On or about October 1, 2019, during construction activities near the loading area on floor level 1, the employer did not ensure that the midrail was installed in the wooden guardrail system while an employee guided the forklift into the area, exposing the employee to a fall hazard of about 11 feet.

29 CFR 1926.502(b)(4): The top edge of the guardrail was able to deflect to a height less than 39 inches (1.0 m) above the walking/working level: Instances including, but not limited to, the following: a) Job site, 320 East North Avenue, Pittsburgh, PA: On or about October 1, 2019, during construction activities near an elevator shaft on floor level 1, the employer did not ensure that guardrail systems were compliant in that the top rail was able to be pushed down by hand to a level of at least approximately 34 1/2 inches.
