OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries while working beneath loads suspended from an excavator.     a) Scrapyard area: On or about October 5, 2019, A CAT model 312C excavator equipped with a bucket and thumb attachment was used to raise a vehicle off the ground.  Work was performed under the vehicle without the vehicle being supported, cribbed, or braced.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident     a) TC Repair, LLC: On or about October 5, 2019 a work place fatality occurred that was not reported to OSHA within 8 hours.  The employer was aware of the fatality on October 5, 2019 but the fatality was not reported until October 7, 2019.
