29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) Heights Clinic Expansion and Remodel Project, 44 Wicks Lane, Billings MT 59105: On October 7th, 2019 and at times prior, employees were exposed to cave-in hazards while installing 6 inch fireline in an unprotected trench at a depth of 6 feet 6 inches with one vertical wall. The competent person failed to remove employees from the hazardous location. The Earth Movers Excavation Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(2), which was contained in OSHA inspection number 1353158, citation number 1, item 1/a and was affirmed as a final order on November 19, 2018, with respect to the workplace located at Starner Gardens Project, Billings, MT, 59105.
