29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) Excavation behind F. Wilbur Gingrich Library - On or about October 3, 2019, an employee entered the excavation and worked in the vault at the bottom of the north end, which measured 7 feet deep from the ground down to the top of the vault. The excavation, dug in Type B soil, did not have protection systems that complied with the standard or safe means of egress, and the employee had not received effective information and training on recognizing and avoiding trenching and excavation hazards at the work site. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Wilbur Gingrich Library - On or about October 3, 2019, an employee entered the excavation, dug in Type B soil, and worked in the vault at the bottom of the north end, and the employer did not have a competent person inspect the excavation, exposing the employee to hazards, including, but not limited to, getting struck-by sliding/falling soil and rocks. 29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) Excavation behind F. Wilbur Gingrich Library - On or about October 3, 2019, an employee entered the excavation, dug in Type B soil, by walking down the east wall, to work in the 4.5-foot high concrete vault at the bottom of the north end. The excavation depth measured 7 feet deep from the ground down to the top of the vault. The excavation did not have a stairway, ladder, ramp or other safe means of egress, exposing the employee to the hazard of slipping and falling and to the hazard of delayed escape in the event of an emergency. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) Excavation behind F. Wilbur Gingrich Library - On or about October 3, 2019, an employee entered the excavation, dug in Type B soil, and worked in the vault at the bottom of the north end, which measured 7 feet deep from the ground down to the top of the vault. The protective systems did not comply with the options in the standard in that on the west side, the excavation had a horizontal area about 3 feet wide at the top of the vault and then a 7-foot high vertical wall above this horizontal area rather than having 1:1 sloping; and on the north side, the excavation had a horizontal area about 4 feet wide followed by irregular benching rather than 1:1 sloping, exposing the employee to hazards, including, but not limited to, getting struck-by sliding/falling soil and rocks. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
