29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold.     (i) Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold shall be protected by a personal fall arrest system    a.)  On October 10, 2019, an employee was exposed to a 21 foot fall hazard from a ladder jack scaffold while performing gutter work on a residential roof and was not protected by a personal fall arrest system.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.    Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    a.) On October 10, 2019, employees were exposed to a 13.5 foot and 24.5 foot fall hazard while performing gutter work on a residential roof and not properly utilizing a fall protection system

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:     (i) as part of a complete personal fall arrest system which maintains a safety factor of at least two; and   (ii) under the supervision of a qualified person.     a.)  On October 10, 2019, employees were exposed to a 13.5 foot and 24.5 foot fall hazard while performing gutter work on a residential roof due to the lack of a complete fall arrest system and the improper wrapping of a safety rope around a brick chimney that was not inspected and proven to be capable of supporting at least 5,000 pounds per employee.
