29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by keeping such objects at least 2 feet from the edge of excavations or properly restraining them from falling into the excavation: a) Employees were exposed to excavation hazards; employee was struck by a large rock that rolled off a dirt pile during backhoe operations. Employees are working in close proximity to excavation equipment in a small work area 100 ft by 150 ft lot. Location: 230 Kent Ave, Brooklyn NY On or about 10/8/2019 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a program of frequent and regular inspections made by competent persons at the jobsite: a) The employer did not provide safety inspection/ safety measures when employees were exposed to heavy equipment/ excavation hazards. Employees on foot are working in close proximity to trackhoes, trucks, and drilling rig in the small 100 ft by 150 ft lot. Employee was struck by a large rock (apprx 300 lb) that rolled off a dirt pile during backhoe operations. Location: 230 Kent Ave, Brooklyn NY On or about 10/8/2019 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
