29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:   Boat Yard:  Employees required to wear N95 respirators to protect against health hazards associated with organic vapors and paint dust generated when sanding or painting vessels had facial hair preventing a proper seal.  Employees are exposed to inhalation hazards.

29 CFR 1910.134(f)(2): Employee(s) using a tight-fitting facepiece respirator were not annually fit tested:       Respiratory Protection Program:  The employer requires employees to don 3M N95, 3M Cool Flow (MD. # 7502) half-face and 3M Ultimate FX full face, tight-fitting respirators to protect against health hazards associated with organic vapors from marine paints and epoxies, and dust generated when grinding or sanding vessel surfaces.  Annual fit testing has not been provided.  Employees are exposed to respiratory health hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)        A written hazard communication program was not maintained in the work place for employees using hazardous chemical products such as but not limited to Petit Trinidad marine paints,  International thinner, adhesives, and epoxies.  Employees were exposed to chemical hazards.

29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use.   Safety data sheets (SDSs) were not obtained to replace material safety data sheets (MSDS's) for hazardous chemical products used in the boatyard such as Petit Trinity marine  paints, International thinner, adhesives and epoxies.  The SDSs need to be available for employees to reference during the work shift.
