29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  (a) Facility Wide - On October 16, 2019, the employer did not develop, document and utilize an energy control procedure (lockout/tagout program) and did not provide training on the energy control procedure to ensure that all required elements of the procedure were understood by employees and that the knowledge and skills required for the safe application, usage and removal of the energy controls were acquired by employees performing servicing and maintenance on equipment such as but not limited to the Kramer Graber Vacuum Packaging machine.    In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.212(a)(2): Guard(s) on machine(s) were not affixed to the machine or secured elsewhere when attachment to the machine was not possible:  (a) General Packaging Department - On October 16, 2019, the employer failed to ensure that guards were permanently affixed at the knife and forming portions of the Kramer Graber Vacuum Packaging machine. A steel guard was observed over the knife and forming portions of the equipment, however it was not permanently attached or equipped with a control reliable interlocking system.  On September 27, 2019 a machine operator suffered a finger tip amputation when attempting to prevent the dropped plastic film roll from entering the unguarded knife cutting portion of the Kramer Graber Vacuum Packaging machine, while a maintenance employee was in the process of feeding the plastic film roll.   In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours, either by telephone or in person to the OSHA Area Office that is nearest to the site of the incident, by telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742), or by electronic submission using the reporting application located on the OSHA public web site at www.osha.gov:  (a) The employer did not report an amputation that was the result of a work-related incident to OSHA with in twenty-four (24) hours.   On or about September 27, 2019, an employee suffered a finger amputation on the Kramer Graber Vacuum Packaging machine during film set up. The employer did not report the injury to OSHA until September 30, 2019.   No abatement certification or documentation is required for this item.
