On or about 16 October 2019, the employer failed to ensure that each operator had successfully completed the combination of formal instruction, to include class room instruction, practical training, and an evaluation of the operators performance. 29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about 16 October 2019, at a job site located at 1175 Reading Rd. Montgomery, IL 60538,  employees were observed installing the wooden frames inside of a third story structure without the proper personal protection equipment. Employees were not provided safety glasses to wear when they were required to use pneumatic air guns. This exposed employees to a struck by hazard. All 120-volt, single-phase 15- and 20-ampere receptacle outlets on construction sites, which are not a part of the permanent wiring of the building or structure and which are in use by employees, shall have approved ground-fault circuit interrupters for personnel protection. Montgomery, IL 60538, the employer failed to provide ground-fault circuit interrupters for employee use, exposing them to electrical shock hazards. Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about 16 October 2019, at a job site located at 1175 Reading Rd. Montgomery, IL 60538, employees were not provided fall protection when they were required to install framing, load/unload material from the forks of the forklift, and work around the unguarded windows on the third story of the structure. This exposed employees to a fall hazard of more than 25 feet.   Abatement documentation is required in accordance with 29 CFR 1903.19(d).

29 CFR 1926.701(b): Reinforcing steel. All protruding reinforcing steel, onto and into which employees could fall, shall be guarded to eliminate the hazard of impalement.  On or about 16 October 2019, at a job site located at 1175 Reading Rd. Montgomery, IL 60538, the employer failed to ensure that the employees were protected from being impaled. The reinforced steel (rebar) was sticking out of the ground and did not have caps properly installed to prevent employees from being hurt. This exposed the employees to a struck by hazard. 29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  On or about 16 October 2019, the employer failed to certify that all employees who where authorized to operated the powered industrial trucks had received training prior to use. This exposed employees to a struck by hazard.  Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
