On or about October 8, 2019, an employee was exposed to a struck-by and crushing hazards while being positioned within the swing radius of the XL4100 Gradall excavator.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns. a. On or about October 8, 2019, at the above addressed jobsite, an employee moving broken concrete slabs near a Gradall XL4100 was not wearing a hard hat to protect against impact from heavy equipment operating nearby.
