OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about October 11, 2019 and times prior thereto, in the load out area, employees were exposed to struck-by hazards while working in the area of a front-end loader dumping alfalfa pellets into the pit.

29 CFR 1910.36(c)(1): Each exit discharge must lead directly outside or to a street, walkway, refuge area, public way, or open space with access to the outside. On or about October 11, 2019 and times prior thereto, in the load out area, employees are exposed to struck-by hazards when using the exit door in the mill that discharges to an area where heavy equipment is being operated, such as front-end loaders.
