29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: On or about October 17, 2019, employees were exposed to injury when entering confined spaces. Employees entered covered hoppers to conduct maintenance, repair, welding and cleaning and activities. They used solutions of Clorox Germicidal Bleach, Majestic Ammonia Cleaner or Garden Harvest vinegar to power wash inside railcars with residues of grains, lime and other products. Potential exists for exposure to grain decomposition by-products and for reactions with cleaning agents. The employer did not evaluate the atmospheric hazards to make the determination regarding permit-required confined spaces.
