29 CFR 1926.651(i)(2)(iv): A registered professional engineer did not approve the determination that such excavation work will not pose a hazard to employees.  On or about 17 October 2019, and at times prior thereto, an excavation being performed in the basement of a building had not been pre-approved by a registered professional engineer to determine such work would pose no hazard to those working at the site, exposing the workers to the hazard of a cave-in and collapse of the building.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  On or about 17 October 2019, and at times prior thereto, two laborers were performing concrete place and finish inside an excavation in which the spoil pile was not at least 2 feet away from the edge of the excavation, exposing the workers to the hazard of being struck by excavated materials falling back into the excavation.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift.  On or about 17 October 2019, and at times prior thereto, daily inspections by a competent person in trenching and excavation was not accomplished at the jobsite, exposing two workers to a cave-in hazard.

On or about 17 October 2019, and at times prior thereto, two workers performing place and finish concrete work inside an excavation were not protected from a cave-in with an adequate protective system, exposing the workers to a cave-in hazard of approximately 8-feet 2-inches deep.
