OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards: (a) On or about October 17, 2019 - YKTA Site, employees were exposed to struck-by and crushed-by hazards when the Somero S-22EZ Laser Screed operator was not required to check blind spots before lowering the stabilizers. Warning labels and mirrors were missing.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: (a) On or about October 17, 2019 - YKTA site, employees were exposed to struck-by and crushed-by hazards when the employer had not determined nor documented whether safety toe boots were required when working around a laser screeder.
