29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: a) On October 17, 2019 employees were exposed to a struck-by hazard from construction vehicle and heavy equipment traffic. Employees were not wearing any high visibility clothing or vest. The employees was not readily visible to the heavy equipment operators and construction vehicle traffic while standing outside of a trench, and while walking around a very active part of the jobsite. The construction equipment and traffic included, but was not limited to excavators, front end loaders and dump trucks. Note) Certification of corrective action is required for this item.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety: a) Jobsite: On October 17, 2019, the competent person on site had visually determined the soil type (type C) and that a protective system (trench box) was needed. The competent person and another employee proceeded with work activities in two (2) adjacent excavations before a protective system could be put in place. The excavation depths varied from 5.5 to 7 feet. Note) Certification of corrective action is required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c) of this section: a) Jobsite: On October 17, 2019 employees worked in two (2) adjacent excavations pulling tracer wire and otherwise prepping for a new pipe installation. The excavations measured between 5.5 to 7 feet deep with type C soil. There were no cave-in protective systems in place. NOTE) Abatement certification is required for this item.
