OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to impalement hazards while walking by and working at and near the racking system's protruding vertical support frames that extended approximately 8 inches from the walking/working surface and from the frame connectors that extended another 2 inches from the frames: Location: Mezzanine Level. On or about October 16 of 2019 at the J.C. Penney Project, employees on the mezzanine were walking and working at, near, and over the protruding steel racking system connectors that were not guarded to prevent impalement hazards while doing safety inspections and removing/turning and capping sprinkler heads and sprinkler valves.

29 CFR 1926.850(a): An engineering survey was not performed by a competent person to determine the conditions of the framing floors and walls and the possibility of unplanned collapse of any portion of the structure prior to permitting employees to start demolition operations. Location: Mezzanine Level. On or about October 16 of 2019 at the J.C. Penney Project, an engineering survey was not done to determine if the walking/working surfaces of the mezzanine were structurally strong enough to prevent employees from falling through while doing safety inspections and ongoing work assessments and removing/turning inward sprinkler valves and capping sprinkler heads.

On or about October 16 of 2019 at the J.C. Penney Project, employees on the mezzanine were walking and working at, near, and over metal pan covers that were not structurally strong enough to prevent employees from falling through while doing safety inspections and ongoing work assessments and removing/turning inward sprinkler valves and capping sprinkler heads. An employee stepped onto a metal pan cover and fell through.
