29 CFR 1926.1052(c)(12): Unprotected sides and edges of stairway landings were not provided with guardrail systems that meet the criteria contained in Subpart M of 29 CFR 1926: On or about 10/15/2019 at the 3 Murtha's Way Construction Project, employees were using the East and West stairways to access and descend to and from the 2nd and 3rd floors and had also been installing sheetrock in the landings. No guardrail system or any other fall protection system had been in use at the landings.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b): On or about 10/15/2019 at the 3 Murtha's Way Construction Project, employees were framing the new building and no guardrails were in place in the window openings and no guardrails in use in doorways leading to exterior decks. Upstream Properties, LLC. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1329151, citation number 01, item number 001 and was affirmed as a final order on 08/28/2018, with respect to a workplace located at 87 Salmon Brook in Granby, CT.
