29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) and as referenced by the note contained in 1926.602(d):  On or about 10/15/2019 at the 3 Murtha's Way Construction Project, employees were operating a rough terrain forktruck and no training or evaluation was done.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge:  On or about 10/15/2019 at the 3 Murtha's Way Construction Project, employees were using the East and West stairways to access and descend to and from the 2nd and 3rd floors and no handrail or guardrail system were in use.  The unguarded stairways exposed employees to approximately 10 and 20 foot fall hazards.

29 CFR 1926.1052(c)(12): Unprotected sides and edges of stairway landings were not provided with guardrail systems which met the criteria contained in Subpart M of 29 CFR 1926:  On or about 10/15/2019 at the 3 Murtha's Way Construction Project, employees were using the East and West stairways to access and descend to and from the 2nd and 3rd floors and no guardrail system or any other fall protective system were in use at the landings.  Employees were also installing sheetrock in the landings.   Lack of a fall protection system at the landings exposed employees to approximately 10 and 20 foot fall hazards.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  On or about 10/15/2019 at the 3 Murtha's Way Construction Project, employees were using step ladders to access and descend to and from the roof deck and upper framing areas.  The step ladders were used leaned against the wall in the closed position instead of the required open position, exposing employees to fall hazards.

The employees had to step on the top and top step of the step ladder exposing employees to fall hazards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   On or about 10/15/2019 at the 3 Murtha's Way Construction Project, employees were framing the new building and no guardrails were in place in the window openings and no guardrails in use in doorways leading to exterior decks.  There were no guardrails in use in the east and west stair towers.  No fall protection was in use framing the trusses and installing the plywood to the roof deck.   There were no infeasibility issues and the company did not have a fall protection plan.  Eddi's Contractor, LLC. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1329148, citation number 01, item number 002 and was affirmed as a final order on 10/19/2018, with respect to a workplace located at 87 Salmon Brook in Granby, CT.

29 CFR 1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:  On or about 10/15/2019 at the 3 Murtha's Way Construction Project, employees were using an air compressor that had strain relief damage to the cord exposing the employees to electrical shock and burn hazards.
