29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On or about September 30th, 2019, and at times prior thereto, employees working at ground level and/or on lower levels of scaffolding were not wearing hardhats while other employees worked with materials above. The scaffold was missing toeboards, exposing employees to the hazards of being struck by falling objects.

On or about September 30th, 2019, and at times prior thereto, employees working at heights of greater than 6 feet on a surface with an unprotected side were not protected from falls.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used. On or about September 30th, 2019, and at times prior thereto, employees working at heights of greater than 6 feet that were required to use personal fall arrest systems had not received any training on the use of such equipment, exposing employees to the hazard of falling from height.
