29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On or about September 30th, 2019, and at times prior thereto, employees working at ground level or on lower levels of scaffolding were not wearing hardhats while other employees worked with products that occasionally fell from scaffolding above them that did not have toe-boards comprehensively installed, exposing employees to the hazard of being struck by falling objects.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about September 30th, 2019, and at times prior thereto, employees working at heights of greater than 6 feet on a surface with an unprotected side were not utilizing personal fall arrest systems, exposing employees to the hazard of falling from height.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used. On or about September 30th, 2019, and at times prior thereto, employees working at heights of greater than 6 feet that were required to use personal fall arrest systems had not received any training on the use of such equipment, exposing employees to the hazard of falling from height.
