29 CFR 1910.28(b)(6)(ii): (ii) Each employee 4 feet (1.2 m) or more above dangerous equipment must be protected from falling by:    Located in the rendering department, the folding guardrail gates installed to provide fall protection at A, B, C, & D rendering pit were opened during dumping operations.  Employees were performing various tasks by the back of the semi trailers and the forklifts with combo while the gates were in the open position exposing employees to fall hazards.

29 CFR 1910.29(b)(1):  The employer must ensure guardrail systems meet the following requirements: The top edge height of top rails, or equivalent guardrail system members, are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface.  The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11).    Located in the rendering department, the folding guardrail gates installed to provide fall protection at A, B, C, & D had the top rail installed at a height greater than 45 inches.

29 CFR 1910.29(b)(3):  The employer must ensure guardrail systems meet the following requirements: Guardrail systems are capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied in a downward or outward direction within 2 inches (5 cm) of the top edge, at any point along the top rail;  Located in the rendering department, the folding guardrail gates installed to provide fall protection at A, B, C, & D rendering pit were bent and damages to the point that the system would fail to prevent falls if any lateral force would be applied.

29 CFR 1910.219(c)(2)(i): All exposed parts of horizontal shafting seven (7) feet or less from floor or working platform, excepting runways used exclusively for oiling, or running adjustments, shall be protected by a stationary casing enclosing shafting completely or by a trough enclosing sides and top or sides and bottom of shafting as location requires.    In the Processing Area; the Fat Storage Tank #3 had an exposed rotating shaft on the motor assembly exposing employees to caught in hazards.

The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  The employer did not certify each powered industrial vehicle operator was trained and evaluated.
