29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a. On or about October 29, 2019, the caterpillar model GC40K-STR forklift was found to be unsafe due to the lack of a seatbelt. The forklift had not been taken out of service for repair and was used on an as needed basis to primarily lift barrels in a stationary position.
