OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    Location: 52 Bog & Vly Lane Lincoln, NJ 07035 - warehouse    a) Employees engaged in warehousing activities are exposed to crushing hazards when operating forklifts without using the provided seat belt, or other means of restraint, to ensure they remain safely inside the operator's compartment in the event of sudden unexpected motion. The employer did not ensure that forklift operator restraint devices or seat belts were used. Video footage reviewed on 10/22/19.

The employer did not ensure that each employee on a walking-working surface near an opening, including one with a chute attached, where the inside bottom edge of the opening is less than 39 inches (99 cm) above that walking-working surface and the outside bottom edge of the opening is 4 feet (1.2 m) or more above a lower level is protected from falling:    Location: 52 Bog & Vly Lane Lincoln, NJ 07035 - warehouse baler    a) Employees engaged in warehousing activities were exposed to falling hazards when performing cardboard compacting near a floor opening without a guardrail or other means of fall restraint, to ensure they remain safe on the walking surface. Video footage reviewed on 10/22/19.

29 CFR 1910.37(b)(4): The direction of travel to the exit or exit discharge was not immediately apparent, signs must be posted along the exit access indicating the direction of travel to the nearest exit and exit discharge. Additionally, the line-of-sight to an exit sign must clearly be visible at all times:    Location: 52 Bog & Vly Lane Lincoln, NJ 07035 - warehouse    a) Employees exposed to smoke inhalation hazards; Multiple emergency exit signs were obstructed by stocked carboard materials and could not be observed by staff in the working area on or about 10/22/19.
