Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion, deflagration and fire hazards from combustible dust: Production Floor - The three Dustek indoor dust collectors were not designed, utilized, and maintained to prevent explosions, deflagrations, and fire hazards, in the following instances: a) Dust collectors lacked a means of protecting employees from over-pressurization that may result from an internal combustible dust deflagration. b) Dust collectors lacked a means to isolate employees (via the units' upstream and downstream ducting) from flame front propagation that may result from an internal combustible dust deflagration. c) Dust collectors exhausted air directly indoors and lacked a means to detect and prevent the transfer of hazardous byproducts, such as fire and smoke, back into the facility. d) Dust collectors were not equipped with spark and fire detection systems.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms, service rooms, and walking-working surfaces were not kept clean, orderly, and in sanitary condition: Main Workshop - The surfaces throughout the workshop were covered in fine wood dust, creating fire and deflagration hazards.
