29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels. On or about November 5, 2019, at 1881 SW 3rd St. Pompano Beach, FL 33069 assembly department, an employee operating power tools was exposed to a noise level of 88.0 dBA, which exceeds the 85.0 dBA during the 8-hour time-weighted average representative sampling period. The employer failed to provide the employee with a baseline audiogram within six months of an employee's first exposure above the action level and subsequent annual audiograms.
