29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:        a. Brooklyn Resource Recovery Inc. Employees working around the shredder were exposed to continuous noise. Employees were exposed to 95.3 %, 52.2 %, and 90.9% of the permissible daily noise exposure or an equivalent sound level of approximately 89.7 dBA, 85.3 dBA, and 89.3 dBA respectively. Sampling period was 480 minutes. The employees wear hearing protection. The condition was noted at or around 02/04/2020.          NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
