29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a)Stonebrook Enterprises, LLC at 1000 West Venture Place, Sioux Falls, SD 57105: On or about and at times prior to October 24, 2019, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were conducting various roof repairs to include fascia, drip edge, and shingle repair with no fall protection in place. This condition exposed employees to a fall hazard of approximately 40 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: (a)Stonebrook Enterprises, LLC at 1000 West Venture Place, Sioux Falls, SD 57105: On or about and at times prior to October 24, 2019, the employer did not ensure that employees conducting exterior building repairs on an apartment complex were protected from falls while working from a JLG 660SJ aerial lift. Employees were working from the basket of the lift without the use of a fall protection system while conducting various repairs to include fascia, drip edge, and shingle repair with no fall protection in place. This condition exposed employees to a fall hazard of approximately 40 feet. Abatement Note: Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part 1926.502(d) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).
