29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:    a) At the jobsite, on October 23, 2019, in the excavation approximately forty feet long, three feet wide and up to eight feet deep, a ladder was not located every 25 feet, exposing the employees to the hazards of cave-ins.

29 CFR 1926.651(i)(1):  Where the stability of adjoining buildings, walls, or other structures was endangered by excavation operations, support systems such as shoring, bracing, or underpinning were not provided to ensure the stability of such structures for the protection of employees:    a) At the jobsite, on October 23, 2019, the general contractors job trailer/office was set up along the edge of the excavation and no shoring, bracing or unpinning was used to stabilize the structure to prevent excess weight on the excavation walls, exposing the employees to the hazard of a cave-in.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift:    a) At the jobsite, on October 23, 2019, daily inspections of the excavation were not conducted by a competent person in that the designated competent person did not know how to type soil and did not know at what depth protective systems were required.
