29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:     (a)Elpidio Esteban Enrique dba EEE Construction at 3212 South Hawthorne Avenue, Sioux Falls, SD 57105:  On or about and at times prior to October 25, 2019, the employer did not ensure that each employee that was installing roofing material with the use of a pneumatic nail gun was protected from flying objects by the use of appropriate eye protection. The condition exposed employees to the hazard of a projectile to the eye.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)Elpidio Esteban Enrique dba EEE Construction at 3212 South Hawthorne Avenue, Sioux Falls, SD 57105: On or about and at times prior to October 25, 2019, the employer did not ensure that each employee engaged in roofing operations on a residential project had been trained to recognize the hazards associated with working at elevations over 6 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet. The condition exposed employees to a fall hazard of approximately 11 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    (a)Elpidio Esteban Enrique dba EEE construction at 3212 South Hawthorne Avenue, Sioux Falls, SD 57105:  On or about and at times prior to October 25, 2019, the employer did not ensure that each employee was protected from falls from heights in that employees were utilizing ladders that were not extended at least three feet above the upper landing surface to gain access to the roof. This condition exposed employees to a fall hazard of approximately 11 feet.
