The side rails of the ladder extended less than 3 feet above the surface of the earth.

29 CFR 1926.652(b)(3)(iii): Tabulated data, identifying the registered professional engineer who approved the data, was not maintained at the jobsite during construction of the protective system. After that time, that data was not made available to the Secretary when requested. On McKinstrey Street, Chicopee, MA on or about October 29, 2019, the employer did not possess the tabulated data for the protective system which had been assembled, placed and removed from the open excavation without having the tabulated data available onsite for reference.
