29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Negrete Zalasar located at 1677 Melick Drive, Delaware, OH 43015: On and preceding October 29, 2019, the employer did not ensure that employees wore eye protection while utilizing pneumatic nail guns.  Workers were installing siding and other trim pieces using a pneumatic nail gun powered at 150 psi without the use of eye protection.  the following condition exposed employees to struck-by hazards to the eyes.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a) Negrete Zalasar located at 1677 Melick Drive, Delaware, OH 43015: On and preceding October 29, 2019, the employer did not ensure that employees on scaffolds more than 10 feet above a lower level were not protected from falling to that lower level by fall protection.  Workers were on a pump jack scaffold at heights between 10-18 feet installing siding and other trim pieces.  The pump jack scaffold did not have guardrails nor was any other method of fall protection utilized.  The following condition exposed employees to falls from up to 18 feet.

29 CFR 1926.451(h)(2): Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section:  a) Negrete Zalasar located at 1677 Melick Drive, Delaware, OH 43015: On and preceding October 29, 2019, the employer did not ensure that employees working below a scaffold were protected from falling tools, materials or equipment.  A pump jack scaffold was being utilized with an extension ladder being used as a work platform for tools and equipment.  The area beneath the scaffold was not barricaded nor was a toeboard or other means to prevent tools/equipment falling and striking employees utilized.  The following condition exposed employees to struck-by hazards.

29 CFR 1926.452(j)(2): Poles were not secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary.  a) Negrete Zalasar located at 1677 Melick Drive, Delaware, OH 43015: On and preceding October 29, 2019, the employer did not ensure that the poles  supporting a pump jack scaffold were secured to the structure by bracing or equivalent at the bottom. A pump jack scaffold was being utilized at heights between 10-18 feet for siding installation.  The bottom section of both poles supporting the scaffold were not secured or braced in any way.  The following condition exposed employees to falls up to 18 feet.

Employees were using extension ladders to install siding with the bottom horizontal distance at on-half to three-quarters the working length from the top support.  The following condition exposed employees to falls up to 12 feet.
