29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a)Glammeier Enterprises, LLC at 2300 North Lammers Avenue, Tea, SD 57064: On or about and at times prior to October 29, 2019, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees were conducting framing activities without the use of a fall protection system. The subcontractor was using a personnel basket in conjunction with a rough terrain forklift that did not meet the ANSI requirements and was not secured to the mast of the forklift. This condition exposed subcontractor employees to a fall hazards. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)Glammeier Enterprises, LLC at 2300 North Lammers Avenue, Tea, SD 57064: On or about and at times prior to October 29, 2019, the controlling employer did not ensure subcontractor employees engaged in framing operations were protected from fall hazards by a fall protection system. Subcontractor employees were installing roof sheathing on a residential project without a fall protection system. This condition exposed subcontracted employees to a fall hazard of approximately 16 feet.
