29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. (a) Jobsite: On or about October 30, 2019, three employees were working between the warning line and the edge of the roof and there was no monitor watching them nor were the employees using any personal fall arrest systems. Two of the employees were throwing debris in a steel dumpster and were exposed to fall hazards (to asphalt) that ranged from 7 feet 3 inches to 8 feet 9 inches. A third employee went beyond the warning line at least two times to move 4, 5 gallon white metal buckets back inside the warning line. The fall hazard to this third employee was about 18 feet onto concrete.

29 CFR 1926.503(c)(3): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: (a) Jobsite: On or about October 30, 2019, the employees on the site need to be retrained on when to use personal fall protection and/or when to use safety monitors when doing roof work.
