OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard by falling objects from uninspected hoist:    On or about November 1, 2019, the employer failed to ensure the hoists were inspected. There are approximately 13 hoists in the fabrication shop and are used on a daily basis to lift metal plates and tanks of various sizes and weights in the process of manufacturing the tanks. The tanks being manufactured ranged in size and capacity from 200 barrel to 400 barrel tanks. Frequent and periodic inspections were not being conducted on the hoist and there were deficiencies identified such as, but are not limited to:    a. The 1 ton Harrington hoist, near the roll bending machine, the hand control/pendant  had piece of plastic missing out of it.  b. The 1 ton Harrington hoist, near the maintenance shop area, the hand control/pendant had hole and piece of plastic missing out of it.
