29 CFR 1926.451(g)(1)(vi): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: Culebra Commons Phase II: On or about November 4, 2019, employees were exposed to a fall hazard greater than 10 feet to the ground below while installing brick from the side bracket of the scaffold that did not have fall protection.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: Culebra Commons Phase II: On or about November 4, 2019, and at times prior thereto, employees were exposed to a fall hazard, while performing masonry work from a tubular scaffold without being trained on fall hazard recognition.
