29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, shall be kept cleared from work areas, passageways, and stairs, in and around buildings or other structures. a) On or about 10/30/19, during the new construction of a townhome, located on 47 Mule Path Circle, in Rochester, New York, the employer did not enforce good housekeeping practices to keep working areas and passageways clear of wood scraps with protruding nails. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) On or about 10/30/19, during the construction of a new townhome, located on 47 Mule Path Circle, in Rochester, New York, employees working on an elevated platform 14 feet above ground level were exposed to open sides without the use of fall protection. The employer did not enforce the use of fall protection. NO ABATEMENT CERTIFICATION REQUIRED
