29 CFR 1926.652(b)(2): Option (2) - Determination of slopes and configurations using Appendices A and B. Maximum allowable slopes, and allowable configurations for sloping and benching systems, shall be determined in accordance with the conditions and requirements set forth in appendices A and B to this subpart. The employer is failing to protect employees from cave-in hazards associated with trenching and excavation work. This was most recently documented at Hwy 35 and Pasewalk Rd, Norfolk, Nebraska on October 30, 2019, when employees were working in an excavation that was 12 feet deep and loose soil rolled off the face of the excavation resulting in injuries to 1 employee.

29 CFR 1926.59: An employer engaged in construction activities did not comply with the requirements set forth in Part 1910, Section 1200, Hazard Communication: 29 CFR 1910.1200(h): Employees were not provided effective information and training as specified in 29 CFR 1910.1200(h)(1) and (2) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area: The employer is failing to protect employees from the hazards of chemicals while performing pipe laying operations. This was most recently observed at Hwy 35 and Pasewalk Rd in Norfolk, Nebraska on November 4, 2019 when an employee was applying pipe lubricant and he had not received HAZCOM training.
