29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a. Neither the employer or his employees were instructed on the requirements for hearing protection (1926.101), and noise levels according to duration of exposure that would require the use of hearing protection (1926.52). (Note: during the inspection the employer would not allow noise measurements of rebar cutting.) b. Neither the employer or his employees were instructed on how to determine required excavation slopes according to soil types, and how to test for soil type as stated in the OSHA regulation. (1926.652(b)(2) requires the use of Appendices A and B to determine soil type. Appendix B states that soil classification shall be in accordance with Appendix A which requires one visual and one manual test (Appendix (c)(2).) Abatement documentation is required for this violation.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles: Safety glasses were not used or required to be used by the employer during use of a cut-off saw with an abrasive blade to cut rebar.
