29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d):  29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.    East side of this commercial building: On or about November 05, 2019, employees were exposed to fall and ejection/crushing hazards, while the forklift operator was not trained and evaluated on the safe operation of a Aerial Lift JLG (Model 460SJ).

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  East side of this commercial building: On or about November 05, 2019, and at times prior thereto, employees were exposed to a fall hazard while welding on a roof from a Aerial Lift JLG (Model: 460SJ) without fall protection.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  East side of this commercial building: On or about November, 05, 2019, and at times prior thereto, employees without fall protection were exposed to a fall hazard greater than 6 feet to the unpaved ground below while welding on a roof.
