29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:    Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.      On November 6, 2019, the employer did not ensure that employees working in an aerial lift were restrained within the aerial lift bucket to prevent ejection, exposing employees to an unprotected fall hazard at approximately 25 feet.      Jerman William Beltran was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 1285652, citation number 1, item number 2 and was affirmed as a final order on January 26, 2018, with a final abatement date of 1/26/2018, with respect to a workplace located at 3900 Riverwalk Dr., #3 Flower Mound TX 75028.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  ON or about November 6, 2019 and at times prior thereto, employees working at heights over 6 feet, the employer did not provide a training program and did not provide hazard awareness and avoidance to employees.  Employees were not ties off and restrained inside the aerial lit basket exposing them to unprotected fall hazards.
