29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or about November 8, 2019; three employees were working on a steep-sloped roof, roofing a house located at 2825 Gillingham Road, McKinney, TX approximately ten (10) feet or more above the ground below and were not protected from a fall hazard.  AGUSTIN MATA-DIAZ WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, (1926.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1254051, CITATION NUMBER 01, ITEM NUMBER 003, AND WAS AFFIRMED AS A FINAL ORDER ON 08/31/2017, WITH RESPECT TO A WORKPLACE LOCATED AT 2718 NORTH BELTLINE ROAD, SUNNYVALE, TX 75182.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed; the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:  (a) On or about November 8, 2019, an employee was observed using a Werner extension ladder placed on the front side of the house located at 2825 Gillingham Road, McKinney, TX. The ladder was only approximately 6 inches above the roofline thereby exposing the employee using it to a fall hazard of approximately ten (10) feet to the ground below.  (b) On or about November 8, 2019, an employee was observed using a Werner extension ladder placed to the right of the entrance at the front of the house located at 2825 Gillingham Road, McKinney, TX. The adder was only approximately 6 inches above the roofline thereby exposing the employee using it to a fall hazard of approximately ten (10) feet to the ground below.  AGUSTIN MATA-DIAZ WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, (1926.1053(B)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1254051, CITATION NUMBER 01, ITEM NUMBER 004, AND WAS AFFIRMED AS A FINAL ORDER ON 08/31/2017, WITH RESPECT TO A WORKPLACE LOCATED AT 2718 NORTH BELTLINE ROAD, SUNNYVALE, TX 75182.
